Question: I am renting a condominium in North Phoenix. The owner’s listing agent told me that he wants to show my condominium to potential buyers, as the owner wants to sell the condominium. I have artwork, furniture, a new Peloton bike, and other items of valuable personal property in the home. Do I have to let the listing agent have access to my home while I am out-of-town next week?
Answer: Probably. The landlord is still the owner of the home. Therefore, the landlord, and the landlord’s listing agent, are entitled to reasonable access to the home. A.R.S. § 33-1343. This reasonable access requires at least two days’ notice to the tenant, and this access must be at reasonable times, e.g., between 10:00 a.m. – 8:00 p.m. Although not required, the notice should be in writing, even if only an email or a text message.
Note: A tenant is entitled to stay in the home during a showing of the home, but cannot interfere with the showing of the home to potential buyers.
